Changes to Queensland secondary dwelling regulations.

Did you know that before September 2022, certain local councils across Queensland prohibited landlords and homeowners from renting out secondary dwellings to unrelated parties? This compounded the housing shortage issues already rife within the market and left owners of rentable property with empty homes and potential tenants with nowhere to live.

In a necessary move by the Queensland government, sweeping changes came into effect that superseded the decision of individual LGA’s across the state to relax the current laws. The outcome being that the factors considered for land use should not be determined by the structure or make-up of a household, meaning that property owners can rent their properties to whomever they choose.

Anyone who currently owns or wants to build a granny flat on their property can now offer it to anyone within the market, and all you need is a standard rental tenancy agreement - Form 18a.
Further information and a link to a blank tenancy agreement can be found at - https://www.rta.qld.gov.au/before-renting/tenancy-agreements

Amidst the evolving Australian residential building and construction industry, a significant shift was introduced this month by the National Construction Code (NCC 2022) that include major changes with a renewed focus on sustainability and accessibility modifications of buildings nationwide. As a governing body under the Australian Building Code Board, the NCC 2022 assists in guiding those involved in the building, designing, and surveying of buildings across the country ensuing the safety, sustainability and accessibility through structural integrity and energy efficiency are met accordingly for the betterment of new builds in Australia. How the changes impact you: The revised changes are diverse and impact various areas of construction, ranging from waterproofing to plumbing, fire safety, and building materials. The restructure that took effect by the NCC 1 May 2024, emphasise a renewed focus on enhancing energy efficiency and accessibility. The adjustments strive to create more inclusive and sustainable spaces and are aimed to protect and to meet the evolving needs, health, and safety of Australians nationwide. The NCC procedures put in place on 1 May 2024; Energy efficiency: A concentrated significance has been applied for energy and sustainability including the design and construction of new builds and extensions to enhance the economic impact within the home. Installation of energy efficient features including ceiling fans and hot water systems, insulation and water tanks set a goal to have all homes at a 7-star energy rating for the building shell and major appliances. These changes are considered to save on the overall running costs of the home, while also contributing to a greener and more sustainable future, a key pillar that the NCC has homed in on with the introduction of the newest regulations. Accessibility: A focus on accessibility was another crucial aspect and incorporates wider hallways and ramped access from the car space to a minimum of one entryway, a condition that can be challenging for granny flat builds due to the need to use pre-existing access and structures. With close to 1 million people in Queensland living with a disability, the necessity to address mobility needs was imperative. This coupled with the Australia’s aging population, prioritized the requirements to introduce minimum accessibility standards for buildings to accommodate all persons no matter what stage of life, or the challenges they face. In the realm of real estate, navigating the path to homeownership can be a daunting journey, especially for first-time buyers. However, amidst the challenges lies a beacon of hope in the form of the First Home Owners Grant (FHOG). This government initiative offers financial assistance to eligible individuals or families embarking on the exciting journey of acquiring their first home. But did you know that this grant can extend beyond traditional home purchases to include granny flat builds? The FHOG has undergone recent updates, making it an even more enticing option for prospective homeowners. For contracts signed between November 20, 2023, and June 30, 2025, the grant amount stands at a generous $30,000. This significant boost in financial aid opens up new possibilities for aspiring homeowners, whether they choose to buy or build their dream abode. When it comes to granny flat builds, the FHOG offers a unique opportunity for multi-generational living arrangements. This alternative housing solution not only provides independence for younger family members but also enhances the value of the parent's property. For parents with children eager to step onto the property ladder amidst the soaring costs of homeownership, a granny flat build presents an ideal compromise. However, before diving headfirst into the granny flat construction, there are crucial considerations to ponder. One must address the intricacies of property ownership and the division of financial responsibilities. With the land title remaining in the name of the original owner, clear communication and mutual understanding are essential to avoid future conflicts. Questions regarding financial arrangements, such as reimbursement in the event of property sale or the possibility of renting out the granny flat, must be addressed upfront. Moreover, contingencies for scenarios like the party building the granny flat desires to relocate or the homeowner's willingness to buy out the granny flat must be outlined to prevent any strain on relationships down the road. Navigating the landscape of granny flat builds under the FHOG requires meticulous planning and open dialogue. While this option may not suit every situation, it presents a viable solution for families seeking both financial assistance and innovative housing arrangements. Exploring options like the FHOG opens doors to a myriad of homeownership opportunities, including the construction of granny flats. By leveraging this grant wisely and engaging in thorough discussions, families can embark on the journey towards homeownership with confidence and clarity.
